A PERM Labor Certification is one of the ways that allows an employer to hire arnforeign worker to work permanently in the United States. The US Department ofrnLabor (DOL) processes applications for PERM Labor Certification. In most cases,rnbefore the US employer can submit an immigration petition to the US Citizenshiprnand Immigration Services (USCIS), the employer must obtain an approved laborrncertification request(Form ETA 9089) from the DOL.
The DOL must certify to the USCIS that there are no qualified US workersrnavailable and willing to accept the job at the prevailing wage for thatrnoccupation in the area of intended employment. The date the PERM laborrncertification application is filed with the DOL is known as the priority date.
